JIVA VIDYA: TERMS OF SERVICE & PRIVACY GOVERNANCE

PART A: TERMS OF SERVICE

1. BINDING AGREEMENT

By accessing, downloading, or using Jiva Vidya (the "App"), you, the user ("You"), enter into a legally binding contract with Little Callet ("Company," "We," "Us"). If you do not agree to every clause herein, you are strictly prohibited from using the App and must delete it immediately.

2. SCOPE OF "ASK KRISHNA" (AI MENTORSHIP)

The "Ask Krishna" interface is a generative AI system designed to act as a long-term spiritual coach.

Longitudinal Context: You acknowledge that for the AI to provide maturing, high-impact guidance, it must utilize your past interactions, Sadhana progress, and the personal attributes provided in your Sadhana Profile.
Nature of Service: Responses are algorithmically generated via Large Language Models (LLMs) and are not the official statements of Little Callet.
No Professional Advice: The AI mentor is a philosophical guide and does not provide medical, legal, or psychological therapy.
Assumption of Risk: While we use your Sadhana Profile to tune responses for accuracy and age-appropriateness, AI can produce inaccuracies ("Hallucinations"). You use this service at your own risk.

3. INTELLECTUAL PROPERTY RIGHTS

The App, including but not limited to the "Hinglish Pills," curated verse translations, gamification logic, the "Sattva Meter" algorithm, and the "Old Book" visual aesthetic, is the sole intellectual property of Little Callet.

Prohibited Acts: Reverse engineering, data scraping, or using our content to train competing AI models is a breach of this contract and will be prosecuted to the maximum extent of the law.

4. TERMINATION & ABSOLUTE DISCRETION

Little Callet reserves the right, in its sole and absolute discretion, to terminate your access to the App, delete your data, or modify any feature (including your earned XP/Awards) at any time, for any reason or no reason, without notice or liability.

5. LIMITATION OF LIABILITY & INDEMNITY

Total Cap: To the maximum extent permitted by law, Little Callet's total liability for any claim shall not exceed the amount you paid to us (if any) in the last 1 week.

Indemnity: You agree to indemnify, defend, and hold harmless Little Callet and its officers from any claims, damages, or legal fees arising from your use of the App or your violation of these terms.

PART B: PRIVACY POLICY & DATA GOVERNANCE

1. DATA COLLECTION & THE "SADHANA PROFILE"

Jiva Vidya is designed to be a lifetime spiritual companion. To provide a personalized experience, we collect:

Identity Data: Name and Email (for account persistence).
Sadhana Profile: Age range (e.g., 25–34), primary spiritual intent (e.g., Inner Peace, Decision Making), and specific learning goals (e.g., Karma Yoga, Scriptural Mastery).
Interaction Data: The full transcript of every interaction with "Ask Krishna" and your progress through the Sadhana Map.
Indefinite Storage: By using the App, you grant Little Callet a license to store this data indefinitely to maintain the continuity of your spiritual coaching and maturing "Teacher-Student" relationship.

2. COMPLIANCE WITH THE INDIAN DPDP ACT (2023)

In accordance with the Digital Personal Data Protection Act of India:

Notice: This document serves as notice of the data we collect and the purposes (service personalization and AI optimization) for which it is used.
Consent: By ticking "I Agree" or by continuing to use the App, you provide unambiguous, affirmative consent for the processing of your personal data.
Right to Erasure: You may request the deletion of your data via the in-app "Delete Account" feature. Note that backups and anonymized logs may persist for a period as required by law or for system security.

3. THIRD-PARTY AI PROCESSING & SUB-PROCESSORS

To generate the "Ask Krishna" responses, the App utilizes Google Gemini (provided by Google Cloud) as a third-party AI sub-processor.

Data Shared: We transmit your specific chat queries, first name, age range, and the spiritual goals defined in your "Sadhana Profile" to Google Gemini.
Data Excluded: We strictly do not share your email address, precise location, or financial records with any AI provider.

Processing Standards: We ensure our third-party AI partners provide data protection standards that are equal to or greater than those outlined in this policy. Data sent for processing is encrypted via HTTPS and is not used by the sub-processor to train foundational models without your additional consent.

PART C: STATUTORY DISCLOSURES & CONTACTS

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the DPDP Act, the details of the Grievance Officer are as follows:

2. MANDATORY AI REPORTING

If you encounter an "Ask Krishna" response that is illegal, harmful, or violates Indian community standards, you are obligated to report it immediately to support@littlecallet.com.

PART D: MISCELLANEOUS

Governing Law: These terms are governed by the laws of India.

Jurisdiction: Any dispute shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Severability: If any part of this document is found unenforceable, the remainder remains in full force.
